Overview

Children's toys are products specified for use by children under 16 years of age when playing. With the current market saturated with various designs and categories, there are hidden safety hazards for children. Therefore, toy products must be declared and certified under QCVN 3:2019/BKHCN in accordance with current laws before they are permitted for circulation.

What is Conformity Certification?

It is the activity of evaluating and confirming a specific product or good's level of compliance with its corresponding technical regulations.

Conformity certification serves as a form of evaluation for a business's products to determine if they meet National Technical Regulations.

Why is Conformity Certification Mandatory for Children's Toys?

Toys are an essential part of almost every child's home. The market today offers a vast array of toys from various domestic and international brands. Alongside reputable products, there are many low-quality, "floating" goods without clear origins. As young children are naturally curious and often unaware of potential dangers, parents face the challenge of selecting safe, high-quality toys. Consequently, toy safety is always a top priority.

Legal grounds for toy conformity certification include:

  • For toys already in circulation: Toys following Circular No. 18/2009/TT-BKHCN before December 31, 2020, were permitted for circulation until the end of December 31, 2021.

  • Current Requirement: Since January 1, 2021, all imported and domestically produced toys must meet the requirements of Section 2, QCVN 03:2019/BKHCN, before being placed on the market.

  • Scope: Businesses, organizations, and individuals manufacturing or importing toys are encouraged to apply these regulations from the effective date of the Circular.

Types of Toys Requiring Conformity Certification

  • Toy bicycles: Tricycles, scooters, pedal cars, and similar wheeled toys; doll carriages.

  • Dolls: With or without clothing.

  • Parts and accessories: Clothing, footwear, and headgear.

  • Electric trains: Including tracks, signals, and other accessories.

  • Scale models: Reduced-size and similar recreational models, whether operational or not.

  • Construction toys: Made of any material except plastic.

  • Animal figures.

  • Puzzles: All types of puzzle toys.

  • Educational toys: Alphabet/number blocks, word-building sets, printing sets, abaci, toy sewing machines, and toy typewriters.

  • Jump ropes.

  • Marbles.

  • Other rubber toys.

List of Products Not Considered Children's Toys (Outside the scope of QCVN 3:2019/BKHCN)

  • Bicycles, except for those considered toys (seat height $\le$ 435 mm).

  • Slingshots/catapults.

  • Darts with metallic points.

  • Equipment for home and public playgrounds.

  • Air and gas-operated guns and pistols.

  • Kites (except for the electrical resistance of kite strings).

  • Model kits, hobby items, or crafts not designed for play.

  • Sporting equipment, camping goods, athletic gear, and musical instruments (however, toy simulations of these items are included).

  • Model aircraft, rockets, boats, and land vehicles powered by internal combustion engines (simulations are included).

  • Collectible products not intended for children under 16.

  • Holiday decorative products.

  • Deep-water equipment, swimming aids, and flotation devices (e.g., swim seats).

  • Toys installed in public places (e.g., arcades, shopping centers).

  • Puzzles with more than 500 pieces or without a picture, intended for professional use.

  • Fireworks, including percussion caps (except those specifically designed for toys).

  • Products with heating elements intended for use under adult supervision for teaching purposes.

  • Steam engines.

  • Video toys connectable to screens operating at a nominal voltage 24V.

  • Pacifiers (dummies) for babies.

  • Faithful reproductions of real weapons.

  • Electric ovens, irons, or functional products operating at 24V.

  • Bows for archery with an overall relaxed length 120cm.

  • Fashion jewelry for children.
