EMC Conformity Certification in Compliance with QCVN 9:2012/BKHCN

QCVN 9 stipulates technical requirements and management requirements regarding limits of electromagnetic disturbances emitted from household electrical and electronic appliances and equipment with similar purposes.

This technical regulation does not specify immunity capability requirements of electrical and electronic equipment.

QCVN 9 applies to enterprises, including organizations and individuals involved in manufacturing, importing, distributing, and retailing electrical and electronic equipment, as well as state management agencies and other related organizations and individuals.

Overview

The National Technical Regulation QCVN 9:2012/BKHCN on electromagnetic compatibility (EMC) for household electrical and electronic appliances and similar purposes was promulgated under Circular No. 11/2012/TT-BKHCN dated April 12, 2012, issued by the Minister of Science and Technology.

Subjects of application of this regulation include organizations and individuals manufacturing, importing, distributing, and retailing (hereinafter referred to as enterprises) electrical and electronic equipment within the scope specified in Clauses 1.1 and 1.2.2; state management agencies and other related organizations and individuals.

Electrical and electronic equipment specified in the Appendix must ensure that electromagnetic disturbances emitted do not exceed the limits prescribed in the corresponding national standards as follows:

Vacuum cleaners, washing machines, refrigerators, freezers, household air conditioners, hand-held motor-operated drills, instant water heaters and similar appliances shall comply with TCVN 7492-1 (CISPR 14-1), Electromagnetic compatibility – Requirements for household appliances, electric tools and similar apparatus.

Market circulation conditions

When circulated on the market, the above electrical and electronic equipment must bear goods labels in accordance with legal regulations on goods labeling; must obtain conformity certification, bear the conformity mark (CR mark), and be subject to market surveillance by product and goods quality inspection authorities.

EMC conformity certification (technical criteria on electromagnetic compatibility)

Certification method

Electrical and electronic equipment manufactured domestically, imported, or traded must obtain EMC conformity certification according to Method 1 (typical sample testing) as specified in Appendix II of the “Regulations on certification of conformity with standards, certification of conformity with technical regulations, and declaration of conformity with standards and technical regulations” issued together with Decision No. 24/2007/QĐ-BKHCN dated September 28, 2007 of the Minister of Science and Technology.

Testing must be conducted by a designated or recognized third-party laboratory.
The validity period of the conformity certificate shall not exceed 3 years.

Conformity certification bodies

Conformity certification shall be carried out by designated or recognized certification bodies.
The designation of certification bodies for EMC conformity certification of electrical and electronic equipment shall be implemented in accordance with Circular No. 09/2009/TT-BKHCN dated April 8, 2009 of the Minister of Science and Technology guiding requirements, procedures, and processes for designation of conformity assessment bodies.

Use of the conformity mark

The conformity mark must comply with Clause 2, Article 4 of the “Regulations on certification of conformity with standards, certification of conformity with technical regulations, and declaration of conformity with standards and technical regulations” issued together with Decision No. 24/2007/QĐ-BKHCN dated September 28, 2007 of the Minister of Science and Technology.

Registration

Enterprises manufacturing electrical and electronic equipment, after obtaining conformity certification, must register the declaration of conformity dossier at the Sub-Department of Standards, Metrology and Quality where the enterprise is headquartered.

Importing enterprises, after obtaining conformity certification, must register quality inspection with the inspection authority in accordance with Circular No. 17/2009/TT-BKHCN dated June 18, 2009 guiding procedures for inspection of imported goods quality.

Registration dossier includes

  • Declaration of conformity registration form (for domestically manufactured equipment) according to Decision No. 24/2007/QĐ-BKHCN; or quality inspection registration form (for imported equipment) according to Circular No. 17/2009/TT-BKHCN.

  • Product description (name, functions, technical specifications, list or invoices of main materials and components…).

  • Overall external color photos including front, top, side views, power plug (if any); trademark (if any); goods label (with basic technical specifications).

  • User manual.

  • Copy of conformity certificate.

  • Notification of changes related to design, materials, or manufacturing technology (if any) compared with registered dossier.

Responsibilities of organizations and individuals

Responsibilities of enterprises

Enterprises manufacturing, importing, distributing, and retailing electrical and electronic equipment must ensure product quality in accordance with the Law on Product and Goods Quality and relevant regulations.

Before placing products on the market, enterprises must affix the conformity mark (CR) to certified equipment and provide evidence when requested by authorities.
During the validity period of the conformity certificate, enterprises must notify certification bodies of any EMC-related design or component changes and retain dossiers for at least 10 years from the date the last registered product type is released.

Responsibilities of certification bodies

Certification bodies must fulfill obligations specified in Circular No. 09/2009/TT-BKHCN and Circular No. 11/2011/TT-BKHCN.
They must receive and process enterprise notifications on EMC-related product changes and retain certification records for at least 6 years after certificate expiry.

Responsibilities of quality inspection authorities

Quality inspection authorities shall perform responsibilities in accordance with Chapter IV of the Law on Product and Goods Quality and relevant regulations.
